In Case No. 2017007080, Licensee was charged with violating Section 471.033(1)(g), Florida Statutes; negligence in the practice of engineering. Mr. Landers acted as the Structural, Electrical, Mechanical (HVAC), and Mechanical (Plumbing) Engineer of Record for the construction of a new residence. Mr. Landers signed, dated, and sealed Electrical Engineering documents. The documents contained material deficiencies. The deficiencies include, but are not limited to, the drawings contain an electrical riser diagram, but no short circuit values and no voltage drop calculations for the feeders and customer-owned service conductors, the conductor serving the 200 amp disconnect switch on the load side of the utility meter shows 3 No. 3/0 conductors for the phases and neutral, but no ground conductor, circuit interrupting devices are shown on the panel schedules but no reference is made regarding fault current interrupting capability, no surge protection devices are shown on the electrical drawings, the spacing of receptacles on the second plan is inadequate, etc. Mr. Landers signed, dated, and sealed Mechanical (HVAC) Engineering documents. The documents material deficiencies. The deficiencies include, but are not limited to, the HVAC drawings contain incomplete equipment schedules for the split system to be installed, no make-up air or combustion air calculations, no ventilation design and no clothes dryer exhaust to the exterior, the drawings are inconsistent in specifying the AC condensate drywell, ductwork is shown on the drawing, but no duct is shown for outside air intake, etc. Mr. Landers signed, dated, and sealed Mechanical (Plumbing) Engineering documents which contained material deficiencies. The deficiencies include, but are not limited to, other than requiring that all plumbing work shall confirm to the 2014 FBC, the drawings do not state specific codes, rules or ordinances to which the plumbing systems must comply, there is no equipment schedule to specify all plumbing fixtures, no storm water diagrams are shown, no area draining calculations are shown, etc. Mr. Landers signed, dated, and sealed Structural Engineering documents which contained material deficiencies. The deficiencies include, but are not limited to, the drawing index on Sheet C1 lists a Landscape Plan and a Schedule of Windows and Doors that were not included in the initial file documentation, the drawings and specifications/notes do not provide any information regarding the design intent for roof drainage, such as the direction and magnitude of roof slope, interior roof drains versus perimeter gutters and downspouts, and the intended roofing materials and installation details, there is not information regarding the required height, materials, and details to be used for handrails and guardrails that are required, the structural calculations do not clearly specify what design dead loads were assumed in the structural design, the building elevations appear to show cantilevered concrete slabs at the west end of the second floor and roof and is inconsistent with the building sections shown on other sheets, no details were provided showing how the slabs are expected to be supported by, or connected to, the structural frame, there are no details showing typical connections between beam and slab components and the supporting columns or walls, etc.

In Case No. 2018013940, Licensee was charged with violating Section 471.033(1)(g), Florida Statutes; negligence in the practice of engineering. This complaint involved failure of a Board required project review from a prior Final Order imposing disciplinary action. Mr. Landers’s provided projects which included Electrical and Mechanical (HVAC & Plumbing) Engineering. Mr. Landers signed, dated, and sealed Electrical Engineering documents which contained material deficiencies. The deficiencies include, but are not limited to, no voltage drop calculations for the feeders and customer-owned service conductors, circuit interrupting devices are shown but there are errors involved with the circuit breakers serving the indoor AHU and the outdoor CA, no surge protective devices are shown on the drawings, the electrical drawings do not contain correct information as required by the FBC, there are no lighting fixture performance specifications, etc. Mr. Landers signed, dated, and sealed Mechanical (HVAC) Engineering drawings which contained material deficiencies. The deficiencies include, but are not limited to, the drawings does not contain adequate information for the AHJ to determine compliance with codes and ordinances, no air conditioning equipment schedules are shown, the drawings do not contain cooling coil requirements based on sensible heat, latent heat and total heat gains, outside air make-up conditions, condensate discharge piping is not shown for AC-2, etc. Mr. Landers signed, dated, and sealed Mechanical (Plumbing) Engineering drawings which contained material deficiencies. The deficiencies include, but are not limited to, the plumbing fixture schedule is incomplete, no are no specifications included, no potable water isometric diagram is shown, total water fixture units are not shown, no sanitary waste isometric diagram is shown, etc.

Ruling: This case was presented to the full Board upon a Settlement Stipulation. The Board imposed an Administrative Fine of $3,000, Administrative Costs of $8,500, a Reprimand, Appearance before the Board, a Permanent Restriction from practicing any Electrical and Mechanical Engineering, probation with terms which include project review at six and 18 months, and the Board’s Study Guide. Final Order was issued on 12/17/19.
